2020 ALABAMA STATE SENATE DISTRICT 26

SPECIAL PRIMARY RUN-OFF ELECTION

Pursuant to §21-4-23(b) of the Code of Alabama (1975), notice is hereby given of the following with regard to Montgomery County, Alabama:

1. Instructions, printed in large type, conspicuously displayed at each voter registration site and polling place, sufficient to provide hearing impaired and seriously visually impaired individuals with adequate information as to how and where they may register and vote.

2. Each polling place shall have an ExpressVote Ballot Marking Device for use by individuals with disabilities who would otherwise be prevented from voting because of their inability to mark a paper ballot, as well as, paper ballots for the use of voters who would otherwise be prevented from voting because of their inability to operate a voting machine.

3. Absentee ballots, available to any handicapped or elderly individual who, because of handicap or age, is unable to go to the polling facility in a state election. The deadlines for requesting and submitting an absentee ballot are the same as prescribed by law for other persons voting by absentee ballot.

4. The opportunity for any handicapped or elderly individual who, because of handicap or age, requires assistance in casting a vote may select a person of his or her choice to accompany them into the polling place to assist in the casting of the vote, providing the person providing assistance is not the voter’s employer, agent of the employer, or an officer or agent of the voter’s labor union.

5. The Alabama State Senate District 26 Special Primary Run-Off Election will be held on December 15, 2020.

ORDINANCE NO.  38-2020

AN ORDINANCE REPEALING CHAPTER 6, ARTICLE V

OF THE CODE OF ORDINANCES FOR THE CITY OF MONTGOMERY

WHEREAS, in 2013, the Alabama Legislature passed the Alabama Private Investigation Regulatory Act, which requires all persons who hold themselves out as private investigators to be licensed by the Alabama Private Investigation Board; and

WHEREAS, §34-25B-19, Code of Alabama, states: “No licensee or applicant shall be required to obtain any authorization or license from, or pay any other fee or post a bond in, any municipality, county, or other political subdivision of this state to engage in any activity regulated under this chapter.”; and 

WHEREAS, the Alabama Private Investigations Regulatory Act does authorize a municipality to impose a business license fee on private investigator licensees; and

WHEREAS, Chapter 16, Article III of the City of Montgomery Code of Ordinances addresses business license fees for private investigators;

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MONTGOMERY, ALABAMA, that Chapter 6, Article V of the Code of Ordinances for the City of Montgomery, Alabama be repealed in its entirety.
