NOTICE OF APPLICATION FOR VACATION OF 

PROPERTY DEDICATED FOR PUBLIC PURPOSES

KNOW ALL MEN BY THESE PRESENTS THAT, whereas, BOWMAN BROS, LLC and the ESTATE OF JOHN S. BOWMAN, are the owners of all of the property abutting or in any way served by the property herein described and the unused road situated thereon, being a portion of Old Federal Road, and collectively own all the lands abutting on or touching said property, and are desirous of vacating a portion of said road over across the property herein described, as provided by Alabama Code Section 35-2-54 and Section 23-4-20.

NOW, THEREFORE, the undersigned, being the owners of all of the lands abutting on the following described property and the unused road situated thereon described as follows:

Being that portion of a thirty (30) foot Right-of-Way known as Old Federal Road abutting property owned by the Estate of John S. Bowman, Sr. and Bowman Bros, LLC, lying in the West ½ of Southwest ¼ of Northwest ¼ of Section 32 Township 14, Range 17.

do hereby declare the above property and that portion of the unused road situated thereon vacated and annulled, and all public rights and easements therein divested of the property subject, however, to all existing rights-of-way or easements for public utilities and to all utility facilities presently situated in said property or vacated hereby.

The declarants do hereby further declare that after vacation that portion of the said public road located as described above, and all public rights and easements therein, convenient means of ingress and egress to and from the property will be afforded to all of the property owners owning property in or near the tract of land embraced by the plat, wherein the above described real property was dedicated for public purposes.

NOTICE IS HEREBY GIVEN that the Montgomery County Commission will consider it for approval said vacation at its meeting to be held on July 6, 2020 at 9:30 a.m. in the Montgomery County Courthouse and Administration Building Annex III, 101 South Lawrence Street, 1st Floor, Commission Chambers, Montgomery, Alabama.
