ORDINANCE NO. 17-2021

AN ORDINANCEAMENDING CHAPTER 3, SECTION 3.15(g) OF THE CODE OF ORDINANCES OF THE CITY OF MONTGOMERY

WHEREAS, Chapter 3, Section 3 of the Code of Ordinances of the City of Montgomery establishes entertainment districts within the city and establishes operational rules for the districts; and

WHEREAS, The City of Montgomery seeks to improve those rules to provide for a safer experience and clearer, uniform requirements for businesses;

NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MONTGOMERY, ALABAMA, that Chapter 3, Section 15(g) of the Code of Ordinances of the City of Montgomery be amended to read as follows:

(g)  Upon the creation of an entertainment district as provided herein:

(1)     Any licensee who receives an entertainment district designation from the Alabama Alcohol Beverage Control Board ("AABCB") shall comply with all laws, rules, and regulations which govern its license type, including the provisions of this section and the resolution creating the district.

(2)     Patrons, guests or members of the licensee may exit the licensed premises with open containers of alcoholic beverages and consume alcoholic beverages anywhere within the confines of the district, but may not enter another licensed premise with open containers or closed containers of alcoholic beverages.

(3)     No licensee who receives an entertainment district designation by the AABCB shall allow alcoholic beverages to be removed from the licensed premises in any bottles or glass containers.

(4)     City of Montgomery will clearly mark the boundaries of the Entertainment Districts by painting verbiage and/or placing signage on sidewalk corners to indicate where the district starts/ends.

(5)     Any and all alcoholic beverages that are served by restaurants and bars in the entertainment districts that will then be carried outside into the district shall be in an apple green plastic disposable cup of any size, a cup with the establishment’s name or logo, a green wristband, or a hand stamp with the establishment’s name or logo.  Restaurants and bars are responsible for purchasing and providing these materials.

(6)     Restaurants and bars must also provide customers with a receipt as proof of purchase of the beverage. Customers are required to keep this receipt on their person while carrying an alcoholic beverage in the districts.  

(7)    Sections (g)(4) through g(6) shall go into effect July 1, 2021.

WHEREAS, the City of Montgomery Armory Learning Arts Center is a division of the City currently aligned with the Department of Parks and Recreation; and

WHEREAS, Ordinance No. 1-2021 must be amended to reflect the realignment of the Armory Learning Arts Center to the Department of Cultural Affairs; and

WHEREAS, the Armory Learning Arts Center is not reflected on the current  organizational chart and its realignment does not affect the organizational chart as depicted in Exhibit A to Ordinance 1-2021; and

WHEREAS, said organizational plan is acceptable to the Council of the City of Montgomery;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MONTGOMERY, ALABAMA, as follows:

5. Installation, configuration and testing of Operational Technology (OT) hardware and software including new servers, network switches, firewalls, operating systems, monitoring software, and management software.

6. Conversion of Human Machine Interface (HMI) software to VTScada.

NOTICE OF PUBLICATION

In this cause it is made to appear to the Court, by the affidavit of the Plaintiff, that DELLA E. HILLER AND FRANK M. GOMES, Defendant(s), whose whereabouts are unknown, must answer Plaintiff’s Complaint for Reformation of Legal Instruments and Declaratory Judgment of the following described property:

Lot Number 33, according to the Map of the Second Division of Cloverdale Terrace, as the same appears of record in the Office of the Judge of Probate of Montgomery County, Alabama, in Plat Book 3, at Page 99.

Also known as: 1524 Sanford Street, Montgomery, AL 36106.

It is therefore, ordered by the Court that publication be made in a newspaper published in the City of Montgomery, County of Montgomery and State of Alabama, for four consecutive weeks, and the said defendant(s) are hereby notified of the issuance of said summons and complaint, and to be and appear if they think propert to defend this suit at the present term of this Court, and within thirty days after this notice by publication is completed.
