AN ORDINANCE AMENDING THE LICENSE TAX CLASSIFICATIONS IN CHAPTER 16, ARTICLE III, SECTION 16-105.

WHEREAS, the Alabama Legislature created the Alabama Private Investigation Regulatory Act (hereinafter, “Act”), which requires any persons who wish to be licensed as private investigators to be licensed by the Alabama Private Investigation Board; and

WHEREAS, the current City of Montgomery Business License Classifications must be amended to remove the requirement of City Council approval for private investigator applicants.

WHEREAS, the current City of Montgomery Business License Classifications categorized private investigator and auto recovery business licenses under one code, Code 561600; and

WHEREAS, the current City of Montgomery Business License Classifications require all private investigator and auto recovery business license applicants to go before the City Council for approval; and

WHEREAS, the Act states that no private investigator licensee shall be required to obtain any authorization or approval from any municipality, county, or other political subdivision of this state to engage in any activity regulated the Act; and

ORDINANCE NO. 23-2020

WHEREAS, Ordinance No. 7-2018, adopted by the Council of the City of Montgomery, Alabama, on February 6, 2018 established the organizational chart for the City government; and

WHEREAS, Ordinance No. 7-2018 must be amended to also reflect the Department of Cultural Affairs, which is a newly created department of the City of Montgomery and will oversee the museum and library; and

WHEREAS, Ordinance No. 7-2018 must be amended to remove the Department of Public Safety, Leisure Services and Department of Community and Neighborhood; and

WHEREAS, the Department of Public Information and External Affairs is being restructured and will no longer be responsible for overseeing the museum and library, which will require Ordinance No. 7-2018 to be amended to reflect this realignment and a change in name to Communications which more accurately reflects the department’s new responsibilities; and 

WHEREAS, Ordinance No. 7-2018 must be amended to reflect a change in name to already existing 311 Customer Service to Neighborhood Services

WHEREAS, Ordinance No. 7-2018 must be amended to realign Fire, Police, Emergency Communications and EMA, which currently aligned with the Department of Public Safety; and

WHEREAS, a revised organizational chart is attached hereto as Exhibit A and made a part hereof; and

WHEREAS, said organizational plan is acceptable to the Council of the City of Montgomery;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MONTGOMERY, ALABAMA, as follows:

Section 1. Ordinance No. 7-2018 be and is hereby amended to include the newly created Department of Cultural Affairs and to remove the Department of Public Safety, Leisure Services and Department of Community and Neighborhood.

Section 2. Ordinance No. 7-2018 be and is hereby amended to reflect a change in name of the Department of Public Information and External Affairs to Communications.
